Tasks and authorities of the agency

In accordance with the Regulation on the Agency on Public Procurement of Goods, Works and Services under Government of the Republic of Tajikistan, approved by the Decree of the Government of the Republic of Tajikistan dated May 3, 2010 No. 228

AGENCY

In the established sphere of activity exercises the following powers:

  • on issues related to the Agency's sphere of competence, submit to the Government of the Republic of Tajikistan drafts of normative legal acts of the resolution of the Republic of Tajikistan;
  • prepares proposals on the targeted use of budget funds intended for the purchase of goods, works and services;
  • ensures mandatory compliance with the requirements of the legislation on public procurement of goods, works and services;
  • promotes the implementation of public procurement of goods, works and services through the provision of advisory assistance, as well as the search for potential suppliers and consumers of goods;
  • in public procurement conducted on behalf of unqualified procuring entities, provides for the unselfish participation of suppliers (contractors) and ensures free competition of applicants;
  • examines complaints and protests on public procurement issues;
  • collects and disseminates information on public procurement;
  • organizes training and retraining of specialists in public procurement;
  • gives recommendations to procuring organizations on the choice and proper application of methods of public procurement of goods, works and services;
  • ежеквартально подготавливает отчет о своей деятельности;
  • forms a database of domestic and foreign suppliers (contractors), maintains a register of unreliable suppliers (contractors);
  • prepares and submits materials on improving the mechanism of public procurement;
  • in accordance with the established procedure, establishes the publication of the Bulletin of Public Procurement and organizes its activities;
  • interacts in due course with state authorities of foreign states, international and foreign organizations;
  • gives to legal entities and individuals explanations and comments on issues related to the established scope of the Agency's activities;
  • takes measures to decentralize government purchases, develops a list of qualified procuring entities that independently carry out public procurement, and submits it monthly to the relevant executive bodies of government and the Government of the Republic of Tajikistan;
  • ensures within its competence protection of information constituting state secrets and other information protected by law;
  • carries out other activities in the established sphere entrusted to the Agency and provided for by laws, regulatory legal acts of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan.

in order to exercise powers in the established field of activity has the right:

  • to exercise control over the activities of procuring entities in respect of compliance with the legislation of the Republic of Tajikistan in the field of public procurement;
  • for the development of regulatory and legal documents, expertise and consultations, to attract specialists of ministries, state committees and other government bodies on a no-cost basis, as well as specialists who are not state employees, on a fee basis in accordance with the procedure established by the legislation of the Republic of Tajikistan;
  • in the established manner, negotiate, conclude agreements with ministries, state committees and other organizations of the Republic of Tajikistan in order to fulfill the tasks assigned to the Agency;
  • in accordance with the legislation of the Republic of Tajikistan, take measures against procuring entities for non-compliance with the Law of the Republic of Tajikistan in the field of public procurement;
  • in order to fulfill the tasks assigned to the Agency, to exercise other powers provided for in regulatory legal acts.
